These Terms of Service ("Agreement") govern your access to and use of the MasterVox.ai platform and services ("Service") provided by Masters Marketing Agency LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by this Agreement. If you do not agree, do not use the Service.
MasterVox.ai is an AI-powered voice agent platform operated by Masters Marketing Agency LLC. The Service enables businesses ("Clients") to deploy automated voice agents that can answer inbound calls, conduct outbound calls, book appointments, send SMS messages, and interact with customers on behalf of the Client.
The Service is powered by third-party AI and telecommunications providers including Anthropic (Claude AI), ElevenLabs (voice synthesis), Deepgram (speech recognition), and Twilio (telephony infrastructure). Your use of the Service is subject to these providers' terms as well as this Agreement.
You must be at least 18 years of age and have the legal authority to enter into this Agreement on behalf of yourself or the organization you represent. By creating an account, you represent and warrant that all registration information you provide is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@mastervox.ai of any unauthorized use of your account.
You are solely responsible for ensuring that all calls placed and SMS messages sent through the Service comply with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and all applicable federal, state, and local laws governing automated calls, prerecorded messages, and text messages.
You must obtain all legally required prior express written consent from call recipients before initiating outbound AI calls or SMS messages. You acknowledge that MasterVox.ai is a tool and that compliance obligations rest entirely with you as the business deploying the AI agent.
You must maintain and honor your own Do Not Call list and must not use the Service to contact any number on the National Do Not Call Registry unless you have a prior established business relationship or have obtained express written consent as required by law.
Many jurisdictions require that callers be informed when they are speaking with an AI or automated system. You are responsible for configuring your AI agents to disclose their automated nature to callers when required by applicable law. MasterVox.ai provides configuration options to include AI disclosure language at the beginning of each call. Failure to configure this disclosure when legally required is your responsibility, not MasterVox.ai's.
The Service may record calls for quality, training, and compliance purposes. Many states require that all parties to a call consent to recording (two-party or all-party consent states). You are responsible for knowing the applicable recording consent laws in your jurisdiction and in the jurisdiction of your callers, and for configuring your agents to provide appropriate disclosures.
You agree not to use the Service to:
We reserve the right to suspend or terminate any account that violates this Acceptable Use Policy without prior notice.
The Service is offered on a subscription basis with the plans and pricing described at mastervox.ai/pricing. Subscriptions are billed monthly in advance. Usage-based charges (such as outbound calling, automated dialing, premium voice add-ons, or minutes that exceed the Fair Use thresholds described in Section 5(a)) are billed in arrears at the applicable per-minute rate.
You may cancel your subscription at any time from your dashboard. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused minutes.
We reserve the right to modify pricing with 30 days' written notice. Your continued use of the Service after the price change takes effect constitutes acceptance of the new pricing.
The Pro, Studio, and Scale plans include unlimited inbound voice calls for typical small and medium business use. "Typical use" reflects the volume and patterns of a legitimate operating business, generally:
Most customers use a small fraction of these thresholds. They exist as a backstop against atypical usage patterns, not as a daily traffic limit.
If your account exceeds the fair-use threshold for your plan in any calendar month, we will reach out within 7 days to review your usage. We may, in our reasonable discretion:
Service is not interrupted, throttled, or degraded based on usage.Outbound calls, automated dialing campaigns, and call recording storage are not included in the unlimited-inbound allotment and are billed separately per the rate card.
Abusive use — including but not limited to telemarketing without proper TCPA consent, spam, illegal activity, deliberately running calls to drain resources, or any use that materially degrades Service availability for other customers — may result in immediate account suspension at our discretion regardless of fair-use thresholds.
Your use of the Service is also governed by our Privacy Policy, available at mastervox.ai/privacy, which is incorporated into this Agreement by reference.
You acknowledge that calls processed through the Service may be transmitted to and processed by third-party AI providers including Anthropic, ElevenLabs, and Deepgram. By using the Service, you consent to this processing and represent that you have obtained any necessary consents from your end users and callers.
If you are subject to GDPR, CCPA, HIPAA, or other data protection regulations, you are responsible for ensuring that your use of the Service complies with those obligations. MasterVox.ai does not represent that it is HIPAA-compliant and should not be used to process Protected Health Information (PHI) without a signed Business Associate Agreement.
Masters Marketing Agency LLC retains all right, title, and interest in the MasterVox.ai platform, including all software, models, prompts, templates, and documentation. Nothing in this Agreement transfers any intellectual property rights to you.
You retain ownership of the content, data, and information you upload or provide to train your AI agents (your "Client Content"). You grant Masters Marketing Agency LLC a limited, non-exclusive license to use your Client Content solely to provide and improve the Service.
You agree to indemnify, defend, and hold harmless Masters Marketing Agency LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of this Agreement or any applicable law; (c) your violation of any third-party rights, including privacy rights and intellectual property rights; (d) any calls, messages, or content transmitted through your account; or (e) any claim by a caller, customer, or regulator arising from your deployment of an AI agent.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MASTERS MARKETING AGENCY LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL MASTERS MARKETING AGENCY LLC'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO MASTERS MARKETING AGENCY LLC IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MASTERS MARKETING AGENCY LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
AI-generated responses are probabilistic and may sometimes be inaccurate, incomplete, or inappropriate. You are responsible for monitoring your AI agents and for the accuracy of information provided to your callers.
Either party may terminate this Agreement at any time. You may terminate by canceling your account through the dashboard. We may terminate or suspend your access to the Service immediately and without notice if you violate this Agreement, the Acceptable Use Policy, or any applicable law, or if we determine in our sole discretion that your use poses a risk to MasterVox.ai, other users, or third parties.
Upon termination, your right to use the Service ceases immediately. Provisions of this Agreement that by their nature should survive termination shall survive, including Sections 8 (Indemnification), 9 (Limitation of Liability), and 12 (Dispute Resolution).
This Agreement is governed by the laws of the State of Hawaii, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall first be submitted to informal negotiation. If not resolved within 30 days, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with proceedings conducted in Honolulu, Hawaii.
YOU AND MASTERS MARKETING AGENCY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in your dashboard at least 14 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those Terms.
